This policy describes how Finia ERP(hereinafter, "Finia ERP", "we"), operated by a natural person (persona natural) from Colombia, collects, uses, stores, and protects the personal data of those who visit this site, register on the waitlist, or use the application at app.finiaerp.com. The processing of personal data described here is subject to Ley 1581 de 2012 (Colombia's data protection statute) and its implementing decrees (Decreto 1377 de 2013), which regulate the right of habeas data (the constitutional right to know, update, and rectify one's personal data) in Colombia.
1. Data Controller (Responsable del Tratamiento)
The data controller (responsable del tratamiento) of the personal data collected through this site and the application is Finia ERP, operated as a natural person (persona natural). Contact channel for any request related to personal data: [email protected].
2. Data We Collect
- Contact data: email address and name, collected through the waitlist form and during registration in the application.
- Account and usage data: access credentials, associated company or companies, roles, and financial/accounting data that the user uploads to the application (bank statements, invoices, accounts receivable / cartera) in order to provide the bank reconciliation, accounts receivable collection (cobro de cartera), and accounting services.
- Technical data: IP address, access logs, and error events, collected for security and diagnostic purposes.
3. Purposes of Processing
Personal data is processed for the following purposes:
- Managing registration on the waitlist and contacting the person when we open spots.
- Creating and administering the account and the tenant(s) of the person or company within the application.
- Providing the contracted bank reconciliation, accounts receivable collection (cobro de cartera), and accounting services.
- Sending transactional communications (confirmations, service notices, support).
- Preventing fraud and abuse, and ensuring the security of the platform.
- Complying with applicable legal and accounting obligations.
4. Authorization (Autorización)
By checking the authorization box on the waitlist form, or by registering in the application, you grant prior, express, and informed authorization (autorización previa, expresa e informada) for the processing of your personal data in accordance with this policy, as required by Article 9 of Ley 1581 de 2012.
5. Rights of the Data Subject (Titular)
As the data subject (titular) of the personal data, you have the right to:
- Know, update, and rectify your personal data.
- Request proof of the authorization granted.
- Be informed about the use that has been given to your data.
- File complaints with the Superintendencia de Industria y Comercio (SIC — Colombia's industry and commerce oversight authority, which enforces Ley 1581) for violations of Ley 1581.
- Revoke the authorization and/or request the deletion of your data, when there is no legal or contractual duty that prevents its deletion.
- Access, free of charge, your personal data that has been subject to processing.
6. Channel and Deadlines for Requests and Complaints (Consulta y Reclamo)
Requests and complaints (consultas y reclamos) regarding your personal data may be filed by email to [email protected]. We will respond as follows:
- Consultas (requests for information): within ten (10) business days following the date of receipt. If it is not possible to respond within that period, we will inform you of the reasons and the date on which it will be addressed, which will not exceed five (5) additional business days.
- Reclamos (complaints): within fifteen (15) business days following the date of receipt. If it is not possible to respond within that period, we will inform you of the reasons and the new date, which will not exceed eight (8) additional business days.
7. National Database Registry (Registro Nacional de Bases de Datos — RNBD)
Finia ERP is operated by a natural person (persona natural). Under current regulations, natural persons are not required to register their databases in the Registro Nacional de Bases de Datos (RNBD — National Database Registry) administered by the SIC.
8. Security and Retention
We apply reasonable technical and administrative measures to protect personal data against unauthorized access, loss, or alteration. We retain data for as long as a relationship exists with the data subject, and for any additional time required by applicable legal, accounting, or tax obligations.
9. Changes to This Policy
We may update this policy. Material changes will be communicated through the site or by email when reasonably possible.
